1. www.suvidhaa.com or any associated website or mobile application ("Website/Application") is an Internet based portal/application owned and operated by Suvidhaa, Use of the Website/Application is offered to you conditioned on acceptance of all the terms, conditions and notices contained in these Terms and conditions, along with any amendments made by Suvidhaa at its sole discretion and posted on the Website/Application, including by way of imposing an additional charge for access to or use of a Service.

3. Suvidhaa shall not be liable or responsible to deliver any product or Services purchased by Users for delivery in locations outside India.
Proprietary Rights
1. You acknowledge and agree that Suvidhaa owns all legal right, title and interest in and to the Services, including any intellectual property rights which subsist in the Services (whether those rights are registered or not). You further acknowledge that the Services may contain information which is designated confidential by Suvidhaa and that you shall not disclose such information without Suvidhaa’s prior written consent.
2. Suvidhaa grants you a limited license to access and make personal use of the website/application and the Service. This license does not confer any right to download, copy, create a derivative work from, modify, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Services. Services
1. The Website/Application is a platform that facilitates the online sale and purchase of products and services offered by Suvidhaa's various affiliate/ registered merchants/ vendors/service providers/ Business /Financial Institutions ("Services"). The Services are offered to the Users through various modes which shall include the purchase of products and services on the Website/Application and the same shall be governed by these terms and conditions.
Usage of the Website/Application
1. The Website/application is intended for personal, non-commercial use. Users above the age of 18 only can register or transact on the Website/application. Website/Application You are responsible for maintaining the secrecy of your activity, transactions, passwords, login and account information. You will be responsible for all use of the Website/application by you and anyone using your password and login information (with or without your permission).
2. You also agree to provide true, accurate, current and complete information about yourself as prompted by the website/application. If you provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or Suvidhaa has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Suvidhaa has the right to suspend or terminate your account and refuse any and all current or future use of the Website/Application (or any portion thereof) or service/products in connection thereto. In case of financial products, if the information provided by you while application, or at a later stage during loan processing is incorrect in any manner, Suvidhaa or the Financial Institution has the right to cancel or modify the loan offer given to you without prior notice to you.
3. By making use of the website/application, and furnishing your personal, contact, financial, bank account, income tax, employment, credit bureau details, you hereby agree that you are interested in availing and purchasing the Services that you have selected. You hereby agree that Suvidhaa may contact you either electronically or through phone, to understand your interest in the selected products and Services and to fulfil your demand or complete your application. You specifically understand and agree that by using the Website/Application you authorize Suvidhaa and its affiliates and Business partners to contact you for any follow up calls and meet you in person in relation to the Services provided through the website/application. You expressly waive the Do Not Call registrations on your phone/mobile numbers for contacting you for this purpose. You also agree that Suvidhaa reserves the right to make your details available to its business partners and you may be contacted by the business partners for information and for sales through email, telephone and/or SMS. You agree to receive promotional materials and/or special offers from Suvidhaa through any electronic or digital mode including but not limited to emails, mobile application notification or SMS.
4. The usage of the Website/Application may also require you to provide consent for keying in your Sensitive Information (SI) (including but not limited to income tax website log in details, income proofs, bank statement, credit bureau score and credit report, employment details, contact information, user ids and passwords), as may be necessary to process your application through this website/application. Sensitive information keyed in or provided shall be required for enabling hassle free, faster and paperless (to the extent possible) processing of applications for financial products so opted / availed by you. Suvidhaa shall adhere to best industry practices in India including information security, data protection and privacy law while processing such applications. However, Suvidhaa shall not be liable to you against any liability or claims which may arise out of such transactions.
5. You may only use the Website/application to avail various products and services offered by the website/application including search for and to apply for financial products as may be displayed on the website/application from time to time and you shall not use the Website/application to make any fraudulent applications. You agree not to use the Website/application for any purpose that is unlawful, illegal or forbidden by these Terms, or any local laws that might apply to you. Since the website/application is in operation in India, while using the Website/application, you shall agree to comply with laws that apply to India. We may, at our sole discretion, at any time and without advance notice or liability, suspend, terminate or restrict your access to all or any component of the Website/application.
6. You are prohibited from posting or transmitting to or through this website:
  1. any unlawful, threatening, libelous, defamatory, obscene, pornographic, or other material or content that would violate rights of publicity and/or privacy or that would violate any law;
  2. any commercial material or content (including, but not limited to, solicitation of funds, advertising, or marketing of any good or services); and
  3. any material or content that infringes, misappropriates or violates any copyright, trademark, patent right or other proprietary right of any third party. You shall be solely liable for any damages resulting from any violation of the foregoing restrictions, or any other harm resulting from your posting of content to this website.
User Account, Password, and Security
1. Suvidhaa makes the Services available to You through the Website/application only if You have provided Suvidhaa certain required User information and have opted to create an account ("Account") through log-in ID and password, which can include valid email ID (collectively, the "Account Information"). The Services may also be subject to procedures for use of the Website/application, uploaded guidelines, rules, additional terms of service, or other disclaimer & notices, if any ("Additional Terms"). If there is any conflict between the Terms and conditions and the Additional Terms, the Additional Terms shall take precedence in relation to that service.
2. The Website/application also allows restricted benefits and access to the Services for unregistered Users.
Payment Information
1. You agree to provide correct and accurate details of credit card, debit card, internet banking, e-wallet, UPI or other accepted payment instruments on the Website/application to the approved payment gateway for availing Services on the Website/application. You shall not use payment instruments which are not owned by you, i.e. in any transaction, you must use your own payment instruments. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, police, regulation or court order. You will be solely responsible for the security and confidentiality of your payment instrument details. Suvidhaa expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of your payment instruments.
2. Suvidhaa shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction, on account of you/cardholder having exceeded the preset limit mutually agreed by Suvidhaa with our acquiring bank from time to time.
3. You may add funds and hold balance in the Wallet facility provided by Suvidhaa to ease transaction experience on the Website/application. You can choose to withdraw the available balance in such Wallet to a bank account belonging to you. You agree that you will not withdraw the balance in the Wallet which is funded through a credit instrument like credit card.
4. You can choose to save you credit card/s or debit card/s details for faster payment experience on the Website/application. You agree that your card information is stored with the payment processor and not with Suvidhaa. Hence the responsibility to ensure that such card information is safely stored rests solely with the payment processor and not with Suvidhaa. Such payment processor used by Suvidhaa will be PCI-DSS compliant.
User Obligations
1. Subject to compliance with the T, Suvidhaa grants you a non-exclusive, limited privilege to access and use this Website/application and the Services provided therein.
2. You agree to use the Services, Website/application and the materials provided therein only for purposes that are permitted by:
  1. the Terms and conditions; and
  2. any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.
3. You agree to adhere to all limitations on dissemination, use and reproduction of any materials (such as the product/service catalogues) that you access on the Website/application in accordance with Section 9.
4. You agree not to access (or attempt to access) the Website/application and the materials or Services by any means other than through the interface that is provided by Suvidhaa. You shall not use any deep-link, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website/application or Content (as defined below), or in any way reproduce or circumvent the navigational structure or presentation of the Website/application, materials or any Content, to obtain or attempt to obtain any materials, documents or information through any means not specifically made available through the Website/application.
5. You acknowledge and agree that by accessing or using the Website/application or Services, You may be exposed to content from other users that you may consider offensive, indecent or otherwise objectionable. Suvidhaa disclaims all liabilities arising in relation to such offensive content on the Website/application. Further, you may report such offensive content in the manner prescribed under Section 16 herein.
6. If Website/application allows you to post and upload any material on the Website/application, you hereby undertake to ensure that such material is not offensive and in accordance with applicable laws. Further, you undertake not to:
  1. Defame, abuse, harass, threaten or otherwise violate the legal rights of others;
  2. Impersonate any person or entity, or falsely state or otherwise misrepresent Your affiliation with a person or entity;
  3. Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information through any bookmark, tag or keyword;
  4. Upload files that contain software or other material protected by applicable intellectual property laws unless You own or control the rights thereto or have received all necessary consents;
  5. Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website/application or another's computer;
  6. Engage in any activity that interferes with or disrupts access to the Website/application or the Services (or the servers and networks which are connected to the Website/application);
  7. Attempt to gain unauthorized access to any portion or feature of the Website/application, any other systems or networks connected to the Website/application, to any Suvidhaa server, or to any of the Services offered on or through the Website/application, by hacking, password mining or any other illegitimate means;
  8. Probe, scan or test the vulnerability of the Website/application or any network connected to the Website/application, nor breach the security or authentication measures on the Website/application or any network connected to the Website/application. You may not reverse look-up, trace or seek to trace any information on any other user, of or visitor to, the Website/Application, or any other customer of Suvidhaa, including any Suvidhaa Account not owned by You, to its source, or exploit the Website/Application or Service or information made available or offered by or through the Website/Application, in any way whether or not the purpose is to reveal any information, including but not limited to personal identification information, other than Your own information, as provided for by the Website/Application;
  9. Disrupt or interfere with the security of, or otherwise cause harm to, the Website/Application, systems resources, accounts, passwords, servers or networks connected to or accessible through the Website/Applications or any affiliated or linked sites;
  10. Collect or store data about other users in connection with the prohibited conduct and activities set forth in this Section.
  11. Use any device or software to interfere or attempt to interfere with the proper working of the Website/Application or any transaction being conducted on the Website/Application, or with any other person's use of the Website/Application;
  12. Use the Website/Application or any material or Content for any purpose that is unlawful or prohibited by these Terms and conditions, or to solicit the performance of any illegal activity or other activity which infringes the rights of Suvidhaa or other third parties;
  13. Conduct or forward surveys, contests, pyramid schemes or chain letters;
  14. Download any file posted by another user of a Service that you know, or reasonably should know, cannot be legally distributed in such manner;
  15. Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
  16. Violate any code of conduct or other guidelines, which may be applicable for or to any particular Service;
  17. Violate any applicable laws or regulations for the time being in force within or outside India;
  18. Violate the Terms and conditions including but not limited to any applicable Additional Terms of the Website/Application contained herein or elsewhere; and
  19. Reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website/Application.
7. You agree that you are solely responsible to Suvidhaa and to any third party for any breach of your obligations under the Terms and Conditions and for the consequences (including any loss or damage which Suvidhaa or its affiliates or its Service Providers may suffer) for any such breach.
8. You agree and acknowledge that Suvidhaa is not the seller of the products and the services and Suvidhaa shall in no manner be deemed to be the seller of the products or services on this Website/Application. Suvidhaa is only facilitating purchase/availing of the products or services by you from the Service Provider/vendor/lender partner by facilitating the Services to You. Hence, if there is any defect/deficiency in the product/services of any nature whatsoever, then you are advised to contact the respective Service Partner directly.
9. You agree that Suvidhaa may, at any time, modify or discontinue all or part of the Website/Application, charge, modify or waive fees required to use/avail any product or service the Website/Application, or offer opportunities to some or all Website/Application Users.
Financial Products
1. Financial products displayed on the Website/application are offered by Financial Institutions like Bank, NBFCs and such entities display does not in any way imply, suggest, or constitute any sponsorship, recommendation, opinion, advice or approval of Suvidhaa for such Financial Institutions or their products. You agree that Suvidhaa is in no way responsible for the accuracy, timeliness or completeness of information it may obtain from these third parties. Your interaction with any third party accessed through the Website/Application is at your own risk, and Suvidhaa will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any such third parties or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with the third parties.
2. The financial products displayed on the Website/Application, their terms and conditions, credit policies, availability, interest rate, processing fees, eligibility criteria, documentation / verification requirement is decided solely by participating financial institutions and Suvidhaa has no control on such policies. Such financial products or their details are subject to change without advance notice to You. Suvidhaa is an aggregator of such financial products and does not endorse, sell or promotes them. You acknowledge that you are availing of such financial products directly from the participating financial institutions and not from Suvidhaa.
3. The final approval and disbursal of loans is sole discretion of the concerned financial institution as per its policies.
4. Post disbursal of the loan, you will be a customer of the concerned financial institution and shall be governed by its Terms and Conditions accepted by you during the online application on Suvidhaa.
5. The loan offer given to you during online application is subject to fulfilment of certain conditions like your availability for collection of physical documents and biometric verification, submission of required documents, successful biometric verification, correctness and completeness of information and documents provided by you, etc. In case these conditions are not completed within two working days, Suvidhaa or the concerned Financial Institution has the right to reject the loan offer given during online application without prior notice.
6. Suvidhaa may choose to use external agencies to perform tasks as may be required from time to time to process loan applications, like document collection, eKYC, etc. You acknowledge that Suvidhaa will not be responsible for the conduct of such external agencies or its representatives.
7. During loan application, you may choose to provide your Internet Bank account login credentials to fetch your bank statement for your income and financial details. You agree that such login credentials are stored by a third party bank statement aggregator and not by Suvidhaa. Hence the responsibility to ensure that such login credentials are safely stored and not misused rests solely with such third party bank statement aggregator and not with Suvidhaa. The bank statement aggregator used by Suvidhaa will be a renowned name in such space.
Use of Services/Material
1. Except as expressly indicated to the contrary in any applicable Additional Terms, Suvidhaa hereby grants You a non-exclusive, freely revocable (upon notice from Suvidhaa), non-transferable access to view, and avail various services or any other materials available on the Website/Application, subject to the following conditions:
  1. You may access and use the services/materials solely for personal, informational, and internal purposes, in accordance with the Terms and conditions;
  2. You may not modify or alter Services list/s or any other materials available on the Website/Application;
  3. You may not distribute or sell, rent, lease, license or otherwise make the Service list/s catalogues or any other materials available on the Website/Application available to others; and
  4. You may not remove any text, copyright or other proprietary notices contained in the Service list/s catalogues or any other materials available on the Website/Application.

4. Any purchase of the product or Services from the Website/Application will be strictly for personal use of the User. The User hereby expressly agrees that any product or Services purchased by the User will not be sold, resold, bartered or in any way used for any commercial purposes or for profit. The User hereby acknowledges that the Services or product purchased is not transferrable to any third party for profit.
Usage Conduct
1. You shall solely be responsible for maintaining the necessary computer equipments and Internet connections that may be required to access, use and transact on the Website/Application.
2. You are also under an obligation to use this Website/Application for reasonable and lawful purposes only, and shall not indulge in any activity that is not envisaged through the Website/Application.
3. You shall use this Website/Application for personal, non-commercial use only and shall not re-sell the same to any other person.
4. Intellectual Property Rights
1. The Website/Application and the processes, and their selection and arrangement, including but not limited to all text, graphics, user interfaces, visual interfaces, sounds and music (if any), artwork and computer code (collectively, the "Content") on the Website/Application is owned and controlled by Suvidhaa and the design, structure, selection, coordination, expression, look and feel and arrangement of such Content is protected by copyright, patent and trademark laws, and various other intellectual property rights.
2. The trademarks, logos and service marks displayed on the Website/Application ("Marks") are the property of Suvidhaa or their Service Providers/vendors or respective third parties. You are not permitted to use the Marks without the prior consent of Suvidhaa, the Service Provider/vendor or the third party that may own the Marks.
3. Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, Suvidhaa owns all intellectual property rights to and into the trademark "Suvidhaa", and the Website/Application, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, designs, know-how, trade secrets and inventions, goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks.
4. Except as expressly provided herein, You acknowledge and agree that You shall not copy, republish, post, display, translate, transmit, reproduce or distribute any Content through any medium without obtaining the necessary authorization from Suvidhaa or thirty party owner of such Content.
Third Party Content
The Website/Application makes available general third party information such as, product/Service catalogues, lists of authorized dealers, reports on news, entertainment, technology and features, advertisements including videos, images and photographs of the products/services and other data from external sources ("Third Party Content"). Similar Third Party Content would also be available to you on the email received by you from Suvidhaa. The provision of Third Party Content is for general informational purposes only. You acknowledge that the Third Party Content provided to you is obtained from sources believed to be reliable. Suvidhaa does not provide any guarantee with respect to any the Third Party Content and Suvidhaa shall not be held responsible and/or liable for any loss suffered by you of any nature whatsoever and howsoever, based on your reliance on or use of such data.
Disclaimer
YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
1. THE WEBSITE/APPLICATION, SERVICES AND OTHER MATERIALS ARE PROVIDED BY SUVIDHAA ON AN "AS IS" AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, SUVIDHAA MAKES NO WARRANTY THAT (I) THE WEBSITE/APPLICATION OR THE SERVICES WILL MEET YOUR REQUIREMENTS OR YOUR USE OF THE WEBSITE/APPLICATION OR THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (II) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE WEBSITE/APPLICATION, SERVICES OR MATERIALS WILL BE EFFECTIVE, ACCURATE OR RELIABLE; (III) THE QUALITY OF THE WEBSITE/APPLICATION, SERVICES OR OTHER MATERIALS WILL MEET YOUR EXPECTATIONS; OR THAT (IV) ANY ERRORS OR DEFECTS IN THE WEBSITE/APPLICATION, SERVICES OR OTHER MATERIALS WILL BE CORRECTED. SUVIDHAA ALSO DISCLAIMS ALL LIABILITY WITH RESPECT TO THE MISUSE, LOSS, MODIFICATION OR UNAVAILABILITY OF ANY USER CONTENT.

SUVIDHAA WILL NOT BE LIABLE FOR ANY LOSS THAT YOU MAY INCUR AS A CONSEQUENCE OF UNAUTHORIZED USE OF YOUR ACCOUNT OR ACCOUNT INFORMATION IN CONNECTION WITH THE WEBSITE/APPLICATION OR ANY SERVICES OR MATERIALS, EITHER WITH OR WITHOUT YOUR KNOWLEDGE. INDEMNIFICATION AND LIMITATION OF LIABILITY

You agree to indemnify, defend and hold harmless Suvidhaa including but not limited to its officers, directors, employees, affiliate, vendors agents and business Partner from and against any and all losses, liabilities, claims, damages, demands, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Suvidhaa that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Terms and conditions. Further, you agree to hold Suvidhaa harmless against any claims made by any third party due to, or arising out of, or in connection with, your use of the Website/Application, any claim that Your material caused damage to a third party, your violation of the Terms and conditions, or your violation of any rights of another, including any intellectual property rights.
2. Notwithstanding anything stated herein, Suvidhaa’s entire liability to you under this Terms and Conditions or otherwise shall be the refund of the money/fees charged from you for any specific product or service, for any gross negligence by Suvidhaa, provided however, Suvidhaa gets refund of such monies from its Service Provider/business Partner /Vendor for any such defect/deficiency in the product/service or under which any such unlikely liability arises.

In no event shall Suvidhaa, its officers, directors, employees, partners or suppliers be liable to You, the vendor or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not Suvidhaa has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with Your use of or access to the Website/Application, Services or materials.
VIOLATION OF THE TERMS AND CONDITIONS
1. Governing Law
